These Terms and Conditions ("Terms") govern your access to and use of the emedalert.ai website, app.emedalert.ai mobile application, and related services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.
You must provide accurate, complete information during registration and keep your account information up-to-date. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
By accessing or using the Services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
app.emedalert.ai is a mobile application designed to automatically detect accidents and send instant alerts to emergency services (e.g., 112 in the EU), even when the user is unable to call for help. The application utilizes device sensors and algorithms to identify incidents such as falls, road accidents, or medical emergencies during activities like hiking or sports.
Our services may be used by individuals under the age of 18 only with the express and verifiable consent of a parent or legal guardian. By accessing or using the application, you declare either that you are at least 18 years old or that, as a minor, you have obtained the necessary legal consent to use our Services. In the case of minor users, parents or legal guardians are responsible for supervising the use of the application and for any actions taken within it. We reserve the right to request proof of parental consent at any time and to suspend or restrict access if such consent is not provided. By using the Services, you acknowledge and agree that we comply with applicable data protection laws, including Regulation (EU) 2016/679 (GDPR), and that the processing of personal data of minors under the age of 16 is carried out only with the legal consent of a parent or legal guardian.
We grant you a limited, non-exclusive, non-transferable, revocable license to use eMedAlert for your personal, non-commercial purposes. You may not copy, distribute, or modify any part of the Services without our express written permission.
eMedAlert is not a certified medical device. It is intended for informational and preventive purposes only and should not be used as a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider for medical concerns.
By using our Services, you consent to receive notifications (SMS, email, or push) for emergency alerts and reminders. You may adjust your preferences, but disabling notifications may impact the effectiveness of the application. Standard messaging fees may apply.
You are responsible for providing accurate emergency contact information. eMedAlert is not liable if incorrect or outdated contact data results in failed notifications.

Any registered user on the eMedAlert platform is eligible to participate in the referral system, under the conditions established in this document and the specific rules displayed in the user's panel.
Each user can generate a unique referral code from their personal profile. This code can be shared with others to register on the platform. Those who use such a code will be automatically associated with the referral network of the user who generated it.
Users who refer other active users to the platform will receive a monthly financial reward, calculated as a percentage of the subscriptions paid by those referred. The standard percentages are as follows:
In certain cases, the eMedAlert platform may grant customized commission rates to specific users based on special agreements or strategic partnerships. These exceptions do not affect the rights of other users and do not constitute an obligation to provide equal terms.
Commissions will be processed monthly and can be withdrawn to the user's bank account or another available payment method, according to the platform's policy. The amounts due will be displayed in the user's account, along with the referral activity history.
eMedAlert reserves the right to modify the referral system structure, commission levels, or participation conditions, with prior notice to users through the platform.
Users are required to promote eMedAlert's services in an ethical and legal manner, without abusive or deceptive practices. Any unauthorized use of the referral system may result in account suspension and forfeiture of accumulated commissions.
eMedAlert offers free and paid subscription plans. Prices are subject to change at our discretion. We reserve the right to modify, suspend, or discontinue any subscription or pricing plan at any time with or without notice. Any such changes will not affect active subscriptions until the next billing cycle.
You are solely responsible for the content you submit. You may not upload harmful, offensive, or unlawful material. We reserve the right to remove any content that violates these Terms.
While eMedAlert.ai aims to enhance emergency response through automated alerts, we do not guarantee that alerts will be received by emergency services or that assistance will be dispatched. The effectiveness of the Services depends on various factors, including device functionality, network connectivity, and the accuracy of sensor data. Users should not rely solely on eMedAlert.ai for emergency assistance.
We are not an emergency response service. If you are in immediate danger or require urgent help, call emergency services in your area.
Our collection and use of personal information in connection with the Services are described in our Privacy Policy. By using the Services, you consent to the collection, use, and sharing of your information as outlined in the Privacy Policy.
All content, features, and functionality of the Services, including but not limited to text, graphics, logos, and software, are the exclusive property of eMedAlert.ai and are protected by intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the Services without our prior written consent.

By purchasing an eMedAlert subscription during the pre-sale period, the user agrees to the following special conditions, which supplement and, where applicable, prevail over the general provisions of this document.
Pre-sale subscriptions are offered at a fixed promotional rate, discounted by up to 80% compared to the estimated post-campaign price.
The paid amount grants access exclusively to the active features of the selected plan at the time of purchase, representing the basic package.
The discount applies only during the pre-sale period and covers the basic package for the selected duration (3, 5, or 7 years), starting from account activation.
The payment is non-refundable, except where required by law. By completing the order, the user agrees to the immediate commencement of the service and thus waives the right of withdrawal (in accordance with Romanian Government Ordinance no. 34/2014).
In addition to the basic package, users will benefit from extra features offered free of charge throughout the subscription period.
These additional features will be delivered progressively as they are developed and released, at no extra cost throughout the active duration of the subscription purchased during the pre-sale. They are part of the pre-sale loyalty program, as a token of appreciation for users supporting the early launch of the platform.
Subscriptions purchased during the pre-sale have a fixed duration, corresponding to the selected period (3, 5, or 7 years), starting from the date of account activation.
They do not include automatic renewal. Upon expiration, users may choose any available plan at that time, with no obligation to renew.
Each pre-sale subscription can be transferred once to a new unregistered user, via a unique activation code (“redeem code”) generated in the original account.
Upon activation, the remaining period and all associated rights transfer fully to the new user, who must accept these Terms and Conditions.
The transfer is irreversible, and the original user forfeits all rights associated with the transferred plan.
Users with pre-sale subscriptions may receive early access to experimental features, AI-based modules, updates, and beta testing programs.
Participation in these tests is optional, but availability will be prioritized over standard users or those with later subscriptions.

The pre-sale offer is valid for a limited time, publicly announced on the platform. eMedAlert reserves the right to modify, suspend, or terminate this offer at any time without notice, after the promotional period ends.
After the campaign concludes, the pre-sale offer will no longer be available for purchase.
We reserve the right to suspend or terminate your access to the Services at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users of the Services, us, or third parties, or for any other reason.
TThe Services are provided on an “as is” and “as available” basis. We make no warranties, express or implied, regarding the reliability, accuracy, or availability of the Services. At eMedAlert, we strive to provide accurate and reliable emergency alert services. However, we acknowledge that false or accidental alarms may occur due to various reasons, including but not limited to user error, device malfunction, or environmental factors. No Liability for False or Accidental Alarms eMedAlert is not responsible for any false or accidental alarms triggered by users, devices, or other factors beyond our control. Our role is to facilitate the notification process, but we do not guarantee the absolute accuracy or validity of any alarm signal. Role of Local Authorities In the event of an alarm, local authorities or emergency services may respond based on their own procedures and protocols. eMedAlert has no authority over their actions or decisions. Local authorities are responsible for assessing the situation and taking any necessary measures in response to an alarm. User Responsibility Users are encouraged to familiarize themselves with the proper use of the eMedAlert system to minimize the risk of false or accidental alarms. Any misuse of the service may lead to consequences determined by local authorities. Technical Measures While we strive to minimize false alarms through continuous monitoring and improvement of our technology, eMedAlert cannot guarantee the complete elimination of false or accidental alarms. Agreement to Terms By using the eMedAlert service, users acknowledge and accept this disclaimer regarding false or accidental alarms. They agree that eMedAlert is not liable for any actions taken by local authorities in response to such alarms.
We are not liable for indirect, incidental, or consequential damages, including lost profits, data loss, or personal injury arising from the use of or inability to use the Services. eMedAlert.ai shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Services.
You agree to indemnify, defend, and hold harmless eMedAlert.ai, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Services.
We may update, modify, or discontinue parts of the Service at any time, temporarily or permanently, without notice. We are not liable for any modification, suspension, or discontinuation.We may update these Terms from time to time. Continued use of our Services after changes constitute acceptance. We encourage you to review this page periodically.
We are not liable for failure or delay in performance due to causes beyond our reasonable control, including natural disasters, government actions, or network failures.
These Terms are governed by the laws of Romania. Any disputes will be resolved in the competent courts of Romania.
